Ele \u00e9 parte integrante do Programa de Compliance, com base legal no art. 56 do Decreto 11.129\/2022 e Lei 12.846\/2013 (Lei Anticorrup\u00e7\u00e3o), bem como fundamentado nos princ\u00edpios do Estatuto da institui\u00e7\u00e3o IDAS.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-12591e6 elementor-widget elementor-widget-heading\" data-id=\"12591e6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CAP\u00cdTULO I \u2013 DAS DISPOSI\u00c7\u00d5ES GERAIS<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-774f3a1 elementor-widget elementor-widget-text-editor\" data-id=\"774f3a1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Art. 1\u00ba \u2013 O presente C\u00f3digo de \u00c9tica e Conduta tem como objetivo estabelecer os princ\u00edpios, valores e padr\u00f5es de conduta \u00e9tica esperados dos membros da Diretoria Executiva, Conselhos, Comit\u00ea de \u00c9tica, associados,<br \/>volunt\u00e1rios, colaboradores, prestadores de servi\u00e7o e demais profissionais vinculados ao Instituto IDAS.<\/p><p>Art. 2\u00ba &#8211; Este C\u00f3digo de \u00c9tica \u00e9 normatizado e orientado pelas diretrizes do Estatuto Social da Institui\u00e7\u00e3o e do Programa de Compliance do Instituto IDAS, com os quais mant\u00e9m plena conson\u00e2ncia sendo parte integrada do<br \/>sistema de governan\u00e7a institucional.<\/p><p>Art. 3\u00ba \u2013 Todos os integrantes da institui\u00e7\u00e3o devem atuar com base na legalidade, impessoalidade, moralidade, publicidade, economicidade, efici\u00eancia, integridade, transpar\u00eancia, participa\u00e7\u00e3o social, responsabilidade<br \/>socioambiental e respeito aos direitos humanos.<\/p><p>Art. 4\u00ba \u2013 Este C\u00f3digo aplica-se a todos os ambientes e rela\u00e7\u00f5es institucionais, incluindo atividades presenciais ou remotas, eventos, projetos, parcerias e comunica\u00e7\u00e3o institucional.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-da2b299 elementor-widget elementor-widget-heading\" data-id=\"da2b299\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CAP\u00cdTULO II \u2013 DOS PRINC\u00cdPIOS \u00c9TICOS FUNDAMENTAIS<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0255443 elementor-widget elementor-widget-text-editor\" data-id=\"0255443\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Art. 5\u00ba \u2013 Constituem fundamentos \u00e9ticos do Instituto IDAS:<\/p><p><br \/>I \u2013 O compromisso com a dignidade humana, equidade racial, de g\u00eanero e social;<\/p><p>II \u2013 A valoriza\u00e7\u00e3o da pluralidade, inclus\u00e3o e respeito \u00e0 diversidade;<\/p><p>III \u2013 A defesa dos direitos das crian\u00e7as, adolescentes, mulheres, idosos, pessoas com defici\u00eancia e demais grupos vulner\u00e1veis;<\/p><p>IV \u2013 A atua\u00e7\u00e3o transparente, participativa e em rede com outras organiza\u00e7\u00f5es e \u00f3rg\u00e3os p\u00fablicos ou privados;<\/p><p>V \u2013 A conduta profissional pautada pela verdade, respeito, honestidade, sigilo, zelo e responsabilidade social.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-23dbb81 elementor-widget elementor-widget-heading\" data-id=\"23dbb81\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CAP\u00cdTULO III \u2013 DAS CONDUTAS VEDADAS<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dfdeb7f elementor-widget elementor-widget-text-editor\" data-id=\"dfdeb7f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Art. 6\u00ba \u2013 \u00c9 vedado a qualquer membro ou vinculado ao Instituto IDAS:<\/p><p><br \/>I \u2013 Utilizar a estrutura, recursos, nome ou imagem da institui\u00e7\u00e3o para interesses pessoais, pol\u00edtico-partid\u00e1rios ou religiosos;<\/p><p>II \u2013 Praticar ass\u00e9dio moral, sexual, discrimina\u00e7\u00e3o, racismo, capacitismo ou qualquer forma de viol\u00eancia institucional;<\/p><p>III \u2013 Manipular, omitir ou fraudar informa\u00e7\u00f5es, documentos ou relat\u00f3rios oficiais;<\/p><p>IV \u2013 Subornar, corromper ou participar de esquemas de favorecimento ou fraude;<\/p><p>VI \u2013 Obstruir investiga\u00e7\u00f5es ou retalia\u00e7\u00e3o a denunciantes;<\/p><p>VII \u2013 Exercer fun\u00e7\u00f5es para as quais n\u00e3o possua qualifica\u00e7\u00e3o legal ou registrada;<\/p><p>VIII \u2013 Divulgar indevidamente dados pessoais, cl\u00ednicos ou sens\u00edveis de qualquer assistido.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-72fe669 elementor-widget elementor-widget-heading\" data-id=\"72fe669\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CAP\u00cdTULO IV - DAS OBRIGA\u00c7\u00d5ES DOS MEMBROS DA INSTITUI\u00c7\u00c3O E DEMAIS PROFISSIONAIS E\nVOLUNT\u00c1RIOS DA INSTITUI\u00c7\u00c3O.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-57d47b6 elementor-widget elementor-widget-text-editor\" data-id=\"57d47b6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Art. 7\u00ba &#8211; S\u00e3o deveres comuns a Diretoria Executiva, Conselhos, Comit\u00ea de \u00c9tica, associados, volunt\u00e1rios e<br \/>demais profissionais:<\/p><p><br \/>I- Participar de reuni\u00f5es sempre que houver convoca\u00e7\u00e3o oficial para tratar de assuntos relacionados \u00e0 atua\u00e7\u00e3o da institui\u00e7\u00e3o;<\/p><p>II &#8211; Elaborar relat\u00f3rios peri\u00f3dicos sobre as atividades realizadas especialmente no que se refere a atendimentos e projetos desenvolvidos;<\/p><p>III &#8211; Informar a institui\u00e7\u00e3o qualquer altera\u00e7\u00e3o nos atendimentos que est\u00e3o previsto nos termos da contrata\u00e7\u00e3o profissional;<\/p><p>IV &#8211; Cumprir rigorosamente os prazos e acordos estabelecidos entre a institui\u00e7\u00e3o e o profissional volunt\u00e1rio ou contratado;<\/p><p>V &#8211; Atuar com compromisso e assiduidade nas fun\u00e7\u00f5es assumidas cumprindo os prazos e cronogramas estabelecidos;<\/p><p>VI &#8211; Zelar pelo bom nome da Institui\u00e7\u00e3o.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a731961 elementor-widget elementor-widget-heading\" data-id=\"a731961\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CAP\u00cdTULO V \u2013 DAS INFRA\u00c7\u00d5ES \u00c9TICAS E LEGAIS<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-57938b5 elementor-widget elementor-widget-text-editor\" data-id=\"57938b5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Art. 8\u00ba \u2013 As infra\u00e7\u00f5es \u00e9ticas ser\u00e3o classificadas como:<\/p><p><br \/>I \u2013 Leves: condutas inadequadas sem preju\u00edzo direto \u00e0 institui\u00e7\u00e3o ou terceiros;<\/p><p>II \u2013 Moderadas: condutas que causem dano institucional, desrespeito ou neglig\u00eancia grave;<\/p><p>III \u2013 Graves: crimes, viola\u00e7\u00e3o de direitos, fraudes, corrup\u00e7\u00e3o, desvio de recursos ou viola\u00e7\u00e3o \u00e0 legisla\u00e7\u00e3o vigente.<\/p><p>Art. 9\u00ba \u2013 Quando houver ind\u00edcios de crime, o Comit\u00ea de \u00c9tica dever\u00e1 comunicar imediatamente \u00e0 Diretoria e encaminhar \u00e0s autoridades competentes (Minist\u00e9rio P\u00fablico, Delegacia, \u00d3rg\u00e3os de Controle), sem preju\u00edzo das san\u00e7\u00f5es internas.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3e67d17 elementor-widget elementor-widget-heading\" data-id=\"3e67d17\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CAP\u00cdTULO VI \u2013 DAS PENALIDADES<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eb1a795 elementor-widget elementor-widget-text-editor\" data-id=\"eb1a795\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Art. 10\u00ba \u2013 As penalidades por infra\u00e7\u00f5es \u00e9ticas e legais incluem:<\/p><p><br \/>I \u2013 Advert\u00eancia verbal ou escrita;<\/p><p>II \u2013 Suspens\u00e3o tempor\u00e1ria de atividades e fun\u00e7\u00f5es;<\/p><p>III \u2013 Afastamento preventivo cautelar;<\/p><p>IV \u2013 Destitui\u00e7\u00e3o de cargo ou fun\u00e7\u00e3o ocupada;<\/p><p>V \u2013 Desligamento definitivo do quadro institucional;<\/p><p>VI \u2013 Encaminhamento \u00e0 Justi\u00e7a e responsabiliza\u00e7\u00e3o c\u00edvel e penal.<\/p><p><strong>Par\u00e1grafo \u00fanico:<\/strong> As penalidades ser\u00e3o aplicadas conforme gravidade, reincid\u00eancia e danos causados, assegurando o direito de ampla defesa.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1607d78 elementor-widget elementor-widget-heading\" data-id=\"1607d78\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CAP\u00cdTULO VII \u2013 DO COMIT\u00ca DE \u00c9TICA<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2810a6b elementor-widget elementor-widget-text-editor\" data-id=\"2810a6b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Art. 11\u00ba \u2013 O Comit\u00ea de \u00c9tica \u00e9 inst\u00e2ncia permanente, aut\u00f4noma e deliberativa que atua na preven\u00e7\u00e3o, apura\u00e7\u00e3o e encaminhamento de condutas incompat\u00edveis com este C\u00f3digo.<\/p><p><br \/>Art. 12\u00ba \u2013 Compete ao Comit\u00ea de \u00c9tica:<\/p><p><br \/>I \u2013 Receber e apurar den\u00fancias;<\/p><p>II \u2013 Conduzir processos \u00e9ticos assegurando sigilo, contradit\u00f3rio e ampla<br \/>defesa;<\/p><p>III \u2013 Emitir relat\u00f3rios com recomenda\u00e7\u00e3o de penalidades;<\/p><p>IV \u2013 Propor medidas educativas, preventivas e formativas para o aprimoramento da conduta institucional; incentivar praticas de escuta, inclus\u00e3o e prote\u00e7\u00e3o de direitos; implementar e monitorar o programa de compliance; tomar decis\u00f5es com base em<br \/>crit\u00e9rios t\u00e9cnicos, legais e \u00e9ticos.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2ffe69f elementor-widget elementor-widget-heading\" data-id=\"2ffe69f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CAP\u00cdTULO VIII - CANAL DE DEN\u00daNCIA E RESPONSABILIDADE \u00c9TICA<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e69044d elementor-widget elementor-widget-text-editor\" data-id=\"e69044d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Art. 13\u00ba &#8211; O Instituto IDAS disponibiliza Canal de Den\u00fancia confidencial e seguro, acess\u00edvel por e-mail institucional, para relatos de conduta incompat\u00edveis com este c\u00f3digo. \u00c9 garantido o anonimato do denunciante e vedada qualquer forma de retalia\u00e7\u00e3o.
